Library of STUFF Membership and Borrowing Terms and Conditions V5 - changes from V4 are highlighted
1.1 Be over the age of 18 and understand that you are personally responsible for every item borrowed under the membership regardless of whether it is to be used by your family, your household or an organisation you have been nominated to represent;
1.2 Email or present a valid photo ID to email@example.com prior to borrowing;
Nb. If the photo does not have the current address, a document less than three months old that has the applicant’s name and current address must be produced;
1.3 Accept the Library of STUFF Liability Waiver and Indemnification;
1.4 Understand that you must associate a valid credit card with your account if you wish to reserve items. Without this functionality you will only be able to see what’s available when you attend the Library and this may limit your satisfaction with the initiative.
1.5 Understand that the membership will only be active once payment has been received in full and the applicant has initialed their agreement of the Membership and Borrowing Terms and Conditions and Liability Waiver and Indemnification Declaration
2.1 Members can only borrow items once they have completed the membership registration process and paid for their membership in full;
2.2 If an item breaks or is lost you must notify us as soon as possible (same day unless extenuating circumstances) and replacing or organising the item’s repair is something we expect the lending member to do unless advised otherwise.
2.3 Please return all items clean and in as good a condition as you can manage. We are not a hire company that charges prices to cover paying people to clean, maintain, repair and replace the items. Our members are the volunteers who clean, maintain, repair and replace the items. If you’re happy with that, read on.
Please ensure you allow enough time between borrowing and using the items to check they are fit for your purpose. eg. We have a large stock of catering equipment including cups, plates, cutlery etc that we recommend you double check are clean before use.
2.4 Please consider that items you have borrowed may be reserved for collection on the day you return them so please return items in the first half of the session. To the same point, if you are collecting reserved items please consider attending the Library in the second half of the session to reduce the likelihood of items not yet being returned by the previous borrower.
2.5 The cost of some ‘consumables’ such as whipper snipper cord and oil for the pole saw now attract a surcharge ($2 per week and $3 respectively). Our camping stoves use butane gas cartridges which you can purchase from us for $3 each. Drill bits and blades for saws are not yet attracting a surcharge but we anticipate this will be implemented soon. Any item that requires batteries like the megaphone and camping lantern are not provided with batteries.
The Library of STUFF reserves the right to refuse the loan of any item to any Member at its discretion.
3.1 Only the Member and their immediate family/organisation/school class can use the items they have borrowed.
3.2 All borrowed items must not leave the Member’s possession during the lending period.
3.3 By borrowing an item the member commits to using the item in a safe and responsible manner and Members commit to use the items only for the specific purpose for which it is intended and in accordance with the law and with full understanding that the declaration below has been accepted as a condition of membership.
I, new member , acknowledge that I am over 18 years of age and that I will only borrow items that I feel fully capable and experienced in using from the Library of STUFF Mullumbimby. I agree to use the items in a proper and the manner that they are intended.
I acknowledge and agree that the use of items I borrow may be dangerous and could potentially result in accidents or death. I hereby for myself, in consideration of being permitted to borrow items from the Library of STUFF, waive any and all claims against the Library of STUFF, its officers, agents, and employees for any injury that I may suffer from using items that I borrow from the Library of STUFF.
I, for myself, my successors and assigns, in consideration of being allowed to borrow items, hereby fully agree to release and hold harmless the Library of STUFF, its officers, agents, and employees from all liability, loss, claims, actions or causes of action for the injury or death to any person, persons, or property damage suffered as a result from the use by any person of items I am borrowing from the Library of STUFF. I am aware and acknowledge that the Library of STUFF and its partners, directors, officers, members, and employees claim no expertise concerning any tool for any particular use. I acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by the law.
By signing this waiver, I affirm that I have read the Library of STUFF Membership and Borrowing Terms and Conditions and fully understand that all of the above information is true and may be subject to verification.
I also affirm that I fully understand that failure to comply with any of these terms and conditions may result in revocation or termination of my borrowing privileges and or legal actions against me. I relinquish the right to make any claims against the Library of STUFF, its officers, agents, and employees.
I understand that the Library of STUFF Management Committee takes safety very seriously and that they are compliant with the regulated testing and tagging that is required for electrical items that are lent to members.
I understand that I must safely restrict access to any borrowed items that could be used in a dangerous manner by children.
